Illinois legalized recreational cannabis in 2019 through the Cannabis Regulation and Tax Act, becoming the first state to do so through the legislature (rather than ballot measure). Recreational sales began January 1, 2020. Illinois also has a medical program dating back to 2013.

Tourist RulesTourists 21+ can purchase recreational cannabis but are limited to half the resident amounts (15g flower, 2.5g concentrate, 250mg THC edibles). A valid government-issued ID from any state is accepted.
PenaltiesLegal possession within limits. 30-100g without a card is a civil violation ($200 fine). 100-500g is a misdemeanor. Over 500g is a felony.
Tax InfoRecreational cannabis is taxed based on THC content: 10% for products with ≤35% THC (flower), 20% for infused products, and 25% for products with >35% THC (concentrates). Plus 6.25% state sales tax and local taxes (up to 3%). Medical cannabis is taxed at 1% state sales tax only.

Over 40 qualifying conditions including cancer, Crohn's, epilepsy, fibromyalgia, glaucoma, HIV/AIDS, lupus, MS, PTSD, chronic pain, and others. Illinois has one of the broadest lists in the country.

How to Get a Card

Patients must obtain a physician certification and register with the Illinois Department of Public Health. Application fee is $50 (1-year card) or $100 (2-year card).

Cannabis in Illinois

Illinois made history in June 2019 when it became the first state to legalize recreational cannabis through the legislature rather than a voter ballot measure. The Cannabis Regulation and Tax Act was signed by Governor J.B. Pritzker and included robust social equity provisions.

Recreational sales launched on January 1, 2020, with long lines at dispensaries across the state. Chicago and its suburbs are home to the majority of dispensaries, with additional locations throughout the state.

Resident vs. Non-Resident Limits

One important distinction in Illinois: purchase limits differ based on residency. Illinois residents can buy up to 30g of flower, 5g of concentrate, or 500mg of THC in edibles. Non-residents (including tourists) are limited to exactly half those amounts.

This means out-of-state visitors can purchase up to 15g of flower, 2.5g of concentrate, or 250mg of THC in infused products per transaction.
